Student Loan Forgiveness

Borrowers who receive student loan forgiveness are relieved of the obligation to repay a portion or all of their federal student loan debt. These borrowers borrowed money to pay for their postsecondary education. Some types of loans are eligible for forgiveness, but only those in certain public service, educational, or military professions are eligible.

How Many borrowers will be eligible for  student loan forgiveness?

The Education Department anticipates that at least 40,000 federal student loan borrowers will receive immediate loan forgiveness as a result of the new changes, some through PSLF and others through IDR programs. According to the Department, another 3.6 million borrowers will receive at least three years of additional credit toward IDR student loan forgiveness.

During a press conference on Tuesday, Under Secretary of Education James Kvaal said, “We expect these figures to only grow” as the administration reviews borrower accounts in the coming months. Furthermore, the administration is working on developing a new income-driven repayment plan for borrowers in the future, which could provide even more relief.

How The Student Loan Forgiveness works?

The Education Department announced a one-time adjustment to borrower accounts to provide credit toward loan forgiveness under income-driven repayment for any month a borrower made a payment. Borrowers will be credited regardless of whether they are enrolled in an income-driven repayment plan.

“Every circumstance where a borrower spent a month that could have accrued credit toward IDR forgiveness, we are granting that credit,” James Kvaal, the undersecretary of education, told reporters.

However, the department’s approach to dealing with months when borrowers did not make payments is more complicated.

Officials from the Department of the Treasury stated that they would credit borrowers for months in which they were in long-term forbearances or any type of deferment prior to 2013. However, after 2013, borrowers will not be eligible for automatic credit for months in which they were in default or enrolled in shorter-term forbearances or certain types of deferments.

Eligibility Criteria for Students Loan Waiver?

Borrowers with existing FFEL, Perkins, or other indirect loans who apply to consolidate into the Direct Loan program and submit a PSLF form by Oct. 31, 2022, are eligible for this limited waiver. The waiver only applies to student loans. Parent PLUS loans are ineligible for the PSLF waiver.

Military service members, federal employees, and a few other public service groups are automatically granted PSLF credit. The waiver, in particular, allows active-duty service members to credit deferments and forbearances toward PSLF. According to the US Department of Education, this resolves a problem for service members who had paused payments while on active duty but were not receiving credit toward PSLF.
